Data Protection and Privacy Policy

With the changes in the General Data Protection Regulations from May 2018 our Privacy Policy has been updated.

This privacy policy came into effect on 25th May 2018 and sets out how we collect and use your personal information and what your individual data protection and privacy rights will now be due to these changes.

We at Gary Kay Property value your privacy and we want you to be clear about the information we collect and how we store your data, how we use it and the rights that you have and how you can control your data. When you register your details for becoming a tenant, landlord, vendor or buyer with ourselves we must ask you for certain information which is necessary for us to move your enquiry forward. If you have made an enquiry via our website there may be different questions asked based upon your type of enquiry i.e. tenant, landlord, vendor or buyer.
 
If you supply information to us we will keep this confidential expect if it requested by law, this may be to law enforcement agencies to assist in the detection of criminal acts or government agencies e.g. HMRC. Within Gary Kay Property your information will only be used to prepare and undertake property lettings, management services, property sales and purchases.

Our privacy policy and data protection policy may be changed from time to time to keep up with the ever-changing regulations. We do encourage you to use our website to keep up to date with any changes. If any changes are made we will always make you aware at the time.

 

Managing Your Personal Data

Once you have shared your personal information with us your data will be treated with the upmost confidentiality. Our responsibility to you is to take care and manage your personal data and this will be in line with the current data protection regulations.

If your personal details are given to us either by phone, email, letter or online we will use the information in a lawful manner. Your personal data will only be used for the reasons which you have approached us.

When supplying your information to us your personal data should be accurate and up to date. If you have any changes to your personal data you can contact us by either phone, email or letter. Our contact details can be found on our website.

We do not use your personal data for direct marketing purposes. We only hold your data for the enquiry that you have made to us. If you have made enquiries about specific properties via Zoopla, On the Market or our website and that specific property has been let or sold the data that you will have provided will be deleted from our systems. If you have otherwise stated that you want to be informed of any other properties which may become available, then your information will be retained. If you require your information to be deleted please make us aware of this fact by either letter, email or phone. If we do not receive your request the information collected through the website or portal will be deleted after one year.


Obtaining Consent and Third-Party Information

By Submitting your information your unconditional consent to the use of that information. We will also obtain your written consent to store and share your information with third parties through our application process (for tenants, vendors and buyers) and our property management (for landlords). As tenants we may have to give your information to tradesmen i.e. gas engineers, electricians etc if any problems arise at the property and any work needs to be carried out. We will only do this with your consent.


Using Your Personal Data for Fraud Prevention

We carry out fraud and credit checks on new tenancy applications, new landlords and vendors. To do this, we use data serviced from Credit Reference Agencies and other external agencies/companies that are involved in fraud detection.

We will hold your personal data collected through these processes only for the period applicable to your application, tenancy, management of the property and sale or purchase of any property. Any third party that communicates with you on our behalf must only do so for carrying out the specific services and not for any other purpose. If you have any concerns about any of our third-party processors and partners, please contact us immediately.

 

Transferring Your Personal Data Outside of the EU

Gary Kay Property do not transfer any personal data outside of the EU.


Your Personal Data Rights

Right of Access: You may wish to access a copy of the personal data we hold about you - known as a Subject

Access Request. You can do so by ringing, writing to or emailing Gary Kay Property. We will respond to your Subject Access Request as soon as possible and, in any event, within the statutory 30 days. However, in the event that we need more information from you to verify your identity, which we must do to ensure we disclose your personal data to the right person, the 30 day response period will only commence from the time that we have validated your identity.


Right of Rectification: If you believe we have made an error as to the personal data we hold about you, please speak to us on 01709 867420 and speak to a member of staff who will be able to process the correction for you. Alternatively, you can email us any updates and we will discuss, confirm and amend.


Right of Erasure: You have the right to request your personal data to be permanently deleted from our records and systems to avoid any further communication with you. Your request will always be considered in light of the legal bases that we hold, store and process your personal data and the purpose that we collected your data. Where the legal bases permits, we will carry out your instruction without undue delay. Please note, however, that where we have a legal or contractual obligation to hold your personal data, we may not be able to carry out your request, but we will explain this fully to you. Please address any request to delete your data in writing either to the office or via email to info@zedlettings.com.
 

Right to Restrict Processing: Should you believe that we are processing your personal data in a way that you did not understand or agree to and wish to restrict such processing, please contact us immediately, where a member of staff will be able to assist.


Right to Object to Processing: You have the right to object to certain types of processing of your personal data. We will always make it clear at the outset of any new arrangement with you how we are going to process your personal data. Should you wish to object to such processing, particularly concerning Automated Decisioning and Profiling, we will give you the option to opt out on application. However, should you wish to discuss this matter further, please contact the office to discuss this.
 

Right to Portability: If you wish to move your personal data that we hold on you to another agency, please contact the office to discuss this.
 

Right to be Informed: You have the right to be informed about the collection and use of your personal data. This is commonly known as a 'privacy statement' or 'privacy policy'. We will provide you with the information about how we collect and use your data in various means, such as by 'just in time' notice provided to you at the time of collecting your personal data through our application forms and via this Privacy Policy. Our Privacy Policy is regularly reviewed in line with our business processes. Any changes to this Privacy Policy will be communicated via email to all active customers. You can ask for a printed copy of our Privacy Policy by contacting us.


Right to Complain to the Information Commissioner's Office (ICO): You have a right to lodge a complaint with the Information Commissioner's Office (ICO) if you have a complaint with how you believe your personal data has been handled.
